Ernst highlighted that during the period from June 2023 to May 2025, more than $475 million in taxpayer funds were used to support meals at fast-food restaurants through the RMP. California alone accounted for over 90% of the total national expenditure on the program during this time, with its reach expanding significantly under the Biden administration.

The legislation seeks to close this loophole, emphasizing that “N” in SNAP stands for nutrition, not nuggets or fries. Ernst stated, “I wish I was McRibbing you, but $250 million per year at the drive through is no joke and a serious waste of tax dollars.” The bill aims to restrict benefits from being used at fast food chains, including McDonald’s, Domino’s Pizza, and Jack in the Box.

Ernst’s office noted that while some states do not allow such usage, those that do rely on the 1977 loophole. The proposed measure would require restaurants participating in the program to comply with stricter guidelines, ensuring funds are used for nutrition rather than convenience.
