Deportation of Alleged MS-13 Gang Member Upheld by Immigration Judge

An immigration judge has confirmed the final deportation order for Kilmar Abrego Garcia, an individual accused of gang affiliation and criminal activity. The ruling dismissed his attorneys’ request to reopen the case, upholding the decision to remove him from the United States.

Judge Philip P. Taylor cited insufficient evidence that the Trump administration would definitively deport Garcia to Uganda, though he could be sent to Eswatini or Costa Rica instead. His legal team had argued that Garcia faced potential harm in El Salvador due to his alleged MS-13 ties, but the judge found the evidence lacking.

Garcia’s attorneys initially sought to delay deportation after Homeland Security notified them of possible removal to Uganda, contending he was eligible for asylum. Taylor rejected this claim, stating the motion was filed beyond the 90-day deadline and that no credible risk of harm was proven. The court noted Garcia was not mistreated during interrogations about his alleged gang membership.

The ruling ensures Garcia’s removal from U.S. soil, with authorities confirming the final order stands. His legal team had previously attempted to block the deportation, but the decision remains in effect.
