Florida’s largest grocery store chain, Publix, has announced it will permit customers to openly carry firearms inside its locations across the state. The policy change follows a recent appeals court ruling that declared Florida’s open carry ban unconstitutional.
The decision comes after Florida Attorney General James Uthmeier issued guidance to law enforcement, stating that open carry is now legally permitted in Florida as of September 25, 2025. “Because no other appellate court has considered the constitutionality of Florida’s open carry ban since the SCOTUS decision in Bruen, the 1st DCA’s decision is binding on all Florida’s trial courts,” Uthmeier said.
A Publix spokesperson confirmed the company adheres to all federal, state, and local laws, emphasizing that private businesses retain the right to prohibit weapons on their premises. Specific locations such as courthouses, schools, and government facilities remain off-limits for open or concealed firearms.
Winn-Dixie, one of Publix’s main competitors, maintained its policy against allowing firearms inside stores, stating, “Our priority is creating a safe and welcoming shopping experience for all customers.”
Customer reactions to the change were mixed. Some expressed support, with one shopper noting, “I feel like if you’re going to carry a gun, I’d rather know that it’s on your person than be caught off guard.” Others raised concerns about potential anxiety caused by visible firearms.
The Florida Attorney General’s office clarified that individuals who ignore private property restrictions and carry weapons illegally could face third-degree felony charges for armed trespass.
