The speculation arises from his scheduled book release, “So Ordered: An Originalist’s View of the Constitution, the Court, and the Country,” on October 6. This date coincides with one day before the Supreme Court begins its term for the 2026-2027 judicial session.
Typically, Supreme Court Justices do not publish books during the start of their terms due to court obligations. The timing has raised questions about his potential retirement plans.
If Justice Alito retires at the end of the current term, it would allow President Trump’s administration and Republicans who control the Senate to appoint a replacement before the 2024 midterm elections. Justice Alito will turn 76 in April.
